I have just finished reading Mal Davies excellent E-Book “The Ruth Downey Inquisition” which is an exhaustive examination of the events surrounding the targeting and prosecution of a 73 year old Narrabri farmer Ruth Downey [pictured] by the NSW RSPCA.
That action ended with the RSPCA shooting 50 head of her cattle and bill for court costs of $250,000 .
As you know I don’t subscribe to conspiracy theories. Mal Davies is a retired investigator who has meticulously and clinically examined the events that lead up to the shooting of the cattle in June 2007 and the subsequent prosecution that followed.
What Davies investigation reveals goes far deeper than the persecution of a vulnerable aged pensioner. In Davies own words he claims to have uncovered:
“lies and corruption right from boardroom laywers greed and gravy trains, to an army of mindless persecutors who manipulate awesome legislative power on targeted farmers.”
Davies claims that the RSPCA will not touch corporate farmers, but instead targets vulnerable defenseless small farmers.
As quoted by national RSPCA president Dr Hugh Wirth, when asked back in 2004 during a Four Corners investigation into the RSPCA,
“Why is it that the RSPCA aren’t proactively investigating, and when necessary, prosecuting intensive farming corporations for cruelty to animals?” – he said,
“If I were to do that – if the RSPCA were to do that we would lose our powers. The government would take away our powers as a prosecution authority.”
Gleaning from this, it was a “no no” to target corporate farming. The move to maintain this awesome government-acquired power which the RSPCA enjoys, meant their agenda moved toward targeting family farms.
Davies claims that under the guidance of President Andrew Wozniak the NSW RSPCA targets the most defenseless of Australian farmers.
Initial inquiries revealed that many rural land targets were aged single women working a property on their own. I also established most instances are from NSW RSPCA inspectorate.
The most disturbing allegation that Davies claims his investigations have uncovered are:
Of greater concern, was finding NSW RSPCA President, Andrew Christopher Wozniak [pictured] , a solicitor, and fellow director Paul O’Donnell, a barrister, were reaping hundreds of thousands of dollars per year conducting all NSW RSPCA prosecutions via Mr Wozniak’s law firm, Smythe Wozniak Solicitors.
In the E-Book Davies estimates that the RSPCA has paid its presidents legal firm over $2.5 million dollars over the past 7 years. In 2008 alone -
What we have established from just three ‘Smythe Wozniak Solicitors’ prosecution – invoices this year of 2008, is that they, on a prima facie’ basis, have grossed to the tune, some $593,404.41
This is not the first time questions have been raised about Wozniak’s apparent conflict of interest. NSW Green’s Senator, Ms LEE RHIANNON [pictured] raised the issue in the State parliament on the 24th June 2004 following the airing of the 4 Corners program.
On occasions the RSPCA has employed parties related to, or associated with, senior executives and board members.
That could represent a conflict of interest that should at least be disclosed to members.
For example, members are generally not aware that… ‘the president’s (Andrew Wozniak) aunt is employed as the RSPCA’s bequests officer and that the legal firm in which the president is a partner solicits bequests on behalf of the RSPCA, manages the bequests, and publicly offers to write wills for donors.’
Something stinks to high heaven at the RSPCA … and dare I say … it’s not dead animals.
